Most Evictions can be prevented by returning your keys. Returning the keys is an official act in which the landlord is officially given back possession of their property. If you move out of the property and return your keys prior to your court appearance, you could possibly have the eviction dismissed as “moot.” It is important to try to obtain written proof the keys have been returned. If your landlord refuses, you may be able to return the keys to the landlord in the presence of the judge during your hearing.
In addition to returning keys, establishing a new rental agreement and residence prior to your hearing may provide further proof you are no longer in possession of their property.
While these actions may prevent eviction, this may not negate any rent monies or fees owed to your landlord. There may still be a balance owed and a record of any unpaid debt until paid.
